Terms of Purchase for Decolia

1. General

1.1

These terms of purchase ("the Terms") apply when you, as a consumer, purchase products through www.decolia.se ("the Website").

By completing a purchase on the Website, you accept these Terms. The Terms apply only to consumer purchases made through Decolia's website.

1.2

To shop with Decolia, you must be at least 18 years old or have the consent of a legal guardian in accordance with applicable legislation. We reserve the right to refuse or cancel an order if incorrect information has been provided, fraud is suspected, or if the purchase cannot be completed for any other reason.

1.3

We strive to ensure all information on the Website is accurate and up to date. Despite this, errors may occur, for example regarding product descriptions, images, stock status, technical specifications, or prices.

Decolia reserves the right to correct inaccuracies, update information, and adjust prices without prior notice. If an incorrect price is listed for a product that has already been ordered, we will contact you before processing your order further.

Product images are to be considered illustrative. Colors and details may appear different depending on factors such as your screen or print materials.

1.4

All content on the Website, including but not limited to text, product names, photographs, illustrations, graphics, logos, design, and other material, is the property of Decolia or our licensors and is protected by copyright, trademark law, and other applicable legislation.

Material from the Website may not be copied, distributed, published, or used without Decolia's written permission.

2. Orders and Agreements

2.1

When you complete an order, you confirm that you have read and accept these Terms as well as our Privacy Policy.

2.2

A binding purchase agreement is only formed once Decolia has sent an order confirmation to the email address you provided at checkout.

We recommend that you save your order confirmation, as it acts as your receipt and contains important details about your order.

Until the order confirmation is sent, you have the right to cancel your order. If payment has already been processed, the amount will be refunded to the payment method used at checkout.

3. Customer Details and User Accounts

3.1

When registering an account or completing an order, you will be asked to provide certain personal details.

You are responsible for ensuring that the information you provide is correct and up to date. Incorrect or incomplete information may impact delivery and order processing.

3.2

If you have a customer account, you are responsible for keeping your login credentials secure.

You are liable for all activities and orders placed through your account until you notify Decolia of suspected unauthorized use.

3.3

Decolia has the right to temporarily or permanently close a customer account if misuse, fraud, or a breach of these Terms is suspected.

4. Special Terms for AI-Generated Art

4.1

Certain products sold by Decolia may have been created entirely or in part using artificial intelligence (AI). These designs are produced using advanced AI models and may be edited or customized before being offered for sale.

4.2

We aim to make every design unique. However, due to the large volume of existing artworks and the way AI technology functions, we cannot guarantee that similarities to other works will never occur.

4.3

All intellectual property rights to the Website, the AI systems, and the content provided by Decolia belong to Decolia or our licensors.

Upon purchase, the customer receives the right to use the product for private use. Commercial use, resale, or reproduction requires written approval from Decolia.

4.4

AI-generated art is based on algorithmic processes and is not to be considered an expression of human artistic intent or emotion. The experience and interpretation of the designs are subjective.

4.5

Decolia is not responsible for any perceived similarities between AI-generated designs and other existing works, or for individual interpretations of the designs.

4.6

By using any AI services offered by Decolia, you accept that we have the right to refuse or reject content that in our assessment is unlawful, harmful, offensive, infringing of copyright, or otherwise inappropriate.

4.7

Decolia reserves the right to update or modify these special AI terms at any time if required due to technological developments or changes in legislation.

5. Pricing and Payment

5.1

All prices listed on the Website are in Swedish kronor (SEK) and include value-added tax (VAT), unless otherwise stated.

Any shipping costs, delivery fees, or other additional charges will be displayed at checkout before you complete your purchase.

5.2

Decolia offers the payment methods listed at checkout on the Website at any given time.

Payment is processed in accordance with the terms of the payment method you select. For invoice or installment payments, a credit check may be carried out by our payment partner in line with applicable legislation.

We reserve the right to restrict or modify available payment options if required for technical or security reasons.

6. Promotions and Offers

From time to time, Decolia may offer promotions, discount codes, or other special offers.

Unless explicitly stated otherwise, the following applies:

• Promotions cannot be combined with other offers or discount codes.

• Discounts are only valid for the stated promotional period.

• Offers are valid while stocks last.

• Decolia reserves the right to end or modify a promotion at any time in the event of technical errors, misuse, or obvious pricing errors.

Once a promotion ends, standard prices and terms apply.

7. Gift Cards

Gift cards purchased through Decolia are valid for two (2) years from the date of purchase, unless otherwise stated.

Gift cards may only be used as payment on www.decolia.se and cannot be redeemed for cash.

Lost or stolen gift cards will not be replaced.

If a purchase is paid for partially with a gift card and partially with another payment method, refunds will first be issued to the original payment method in accordance with applicable rules.

Unless otherwise stated, gift cards cannot be combined with discount codes or other promotions.

8. Delivery

8.1

Delivery times are listed on each product page and when you complete your order.

In-stock items are normally shipped within the delivery window stated on the Website. Unless otherwise agreed, delivery will take place no later than 30 days after your order is confirmed.

8.2

If a delivery is significantly delayed and the delay is not your fault as a customer, you have the right to cancel your purchase in accordance with applicable consumer legislation.

In the event of a delay, we will inform you as soon as possible.

8.3

Once your order has been shipped, you will receive delivery information from your chosen carrier.

If a package is not collected within the stated time and is returned to Decolia, we reserve the right to charge an administrative fee equal to our actual costs for return shipping, handling, and administration.

Special terms may apply for custom-made or personalized products if the shipment is not collected.

8.4

Risk of damage to the product transfers to you once you or someone acting on your behalf has received the delivery.

If a shipment is damaged in transit or does not arrive, you must contact Decolia's customer service as soon as possible, and we will help you investigate the issue with the carrier.

9. Right of Withdrawal and Returns

9.1

As a consumer, you have the right to cancel your purchase within the period stated on the Website, which is at minimum the withdrawal period required by applicable consumer legislation.

The withdrawal period begins on the day you or someone receiving the item on your behalf takes delivery of the product.

Personalized products or items manufactured to your specific requirements are not eligible for the right of withdrawal under applicable law.

9.2

If a product is delivered sealed and the seal is broken in a way that means the product can no longer be returned for health or hygiene reasons, the right of withdrawal expires in accordance with applicable law.

9.3

If you wish to exercise your right of withdrawal, you must contact Decolia before the withdrawal period ends.

Your notification should include:

• your name

• your address

• your email address

• your order number

• which products are being returned

You may also use the Swedish Consumer Agency's standard form to exercise your right of withdrawal.

9.4

For returns, you are responsible for the product until it arrives back at Decolia.

The product must be returned well-packaged and in substantially unchanged condition. If the product is handled more than is necessary to assess its features and function, a deduction may be applied for any loss of value in accordance with the Swedish Consumer Purchase Act.

Unless otherwise stated, the customer is responsible for return shipping costs for canceled purchases.

9.5

Once a return has been received and approved, Decolia will refund the amount paid for the returned products.

Deductions may be applied for loss of value if the product has been used to a greater extent than required to inspect it.

9.6

Refunds will be processed without unnecessary delay and no later than 14 days from the date we receive your notification that you wish to cancel your purchase.

We however reserve the right to delay the refund until the returned product has been received, or until you have proven that the item has been shipped back.

Refunds will be processed via the same payment method used at checkout, unless otherwise agreed.

10. Warranty and Complaints

10.1

Certain products sold by Decolia may be covered by a warranty. Information about any warranty period or special warranty terms is listed in the product information or on the Website.

The warranty only covers original material or manufacturing defects, and does not apply to damage caused by normal wear and tear, misuse, accidents, or modifications made by the customer.

Your order confirmation acts as your proof of purchase and should be saved for the duration of the warranty period.

10.2

If a product is defective, you have the right to file a complaint in accordance with applicable consumer legislation.

Complaints must be submitted within a reasonable time after the defect is discovered or should have been discovered. Complaints filed within two months of the defect being detected are always considered to have been submitted on time.

Under Swedish law, you have the right to file a complaint for original defects for up to three years after you receive the product.

10.3

For approved complaints, Decolia will cover reasonable costs for return shipping or other agreed-upon handling.

10.4

Once we have received and inspected the defective product, the case will be processed in accordance with applicable consumer legislation.

If the complaint is approved, the defect may be resolved via repair, replacement, price reduction, or refund, depending on the circumstances.

Decolia abides by decisions from the Allmänna reklamationsnämnden (ARN) in cases where a dispute has been reviewed by that body.

11. External Links

The Website may contain links to external websites or services operated by third parties.

Decolia is not responsible for the content of such websites or for how they process personal data. We recommend that you review the terms of use and privacy policy of any third-party website before using their services.

12. Force Majeure

Decolia is not liable for delays or failure to fulfill our obligations if this is caused by circumstances beyond our reasonable control.

This includes, for example:

• natural disasters

• war or government orders

• strikes or labor disputes

• fire or flood

• major disruptions to power, telecommunications, or data networks

• cyberattacks

• pandemics

• delays from carriers or suppliers that we could not reasonably have foreseen or influenced.

If such a situation arises, we will inform you as soon as is practically possible.

If the obstacle persists for an extended period, both the customer and Decolia have the right to cancel the purchase without liability for damages.

13. Changes to the Terms of Purchase

Decolia reserves the right to update or modify these Terms at any time.

The version of the Terms that applies to your purchase is the version published on the Website at the time you placed your order.

We recommend that you regularly review the latest version of our terms of purchase.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, this will not affect the validity of the remaining provisions.

The invalid provision will in such a case be replaced with a valid provision that achieves, as far as possible, the same original purpose.

15. Applicable Law and Disputes

15.1

These Terms shall be interpreted and applied in accordance with Swedish law.

15.2

If you have questions or are dissatisfied with a purchase, you are always welcome to contact Decolia's customer service. We strive to resolve any disputes through dialogue and a reasonable agreement.

15.3

If we are unable to reach an agreement, you as a consumer may submit your case to the Allmänna reklamationsnämnden (ARN) for a free review of the dispute. More information is available at www.arn.se.

You also have the right to bring legal proceedings before the competent Swedish court in accordance with applicable legislation.
